Positive environmental law as state subsidy

How is positive environmental law a state subsidy for violations of the regnum legis? The combination of the influence of legal positivism (e.g., Anton Menger and Hans Kelsen) and the clout of the power elites on substance of the positive environmental law has led to a situation of the proliferation of the failed technological paradigm that is fossil fuels-based. It is hardly in the interest of these power elites to allow the replacement of failed paradigm with an alternative technological paradigm that would require inventiveness and innovation, because
this would entail R&D-related risk. The resulting technological stagnation prevents finding solutions that comply with the foundations of the Occidental juridical systems (Romano-Germanic and Common Law) and the Occidental identities that provide a path that is free of violence against the laws of the Universe (established by God). The defense of the positive envrionmental law and the failed dominant technological paradigm revolve in the rule around reasonings contained in the opinions of Friedrich von Hayek, but the work of Heinrich Pesch, Rerum Novarum and the Word of God demonstrate that they only excuses; excuses that are incompatible with the aforementioned foundations and identities, and thus the regnum legis.
